Terms & Conditions
The Mary Spender Store is run by nice people and we try to go out of our way to keep our customers happy. As it the way of the world it's only sensible to set down the small print, so we kindly ask you to please read it carefully before shopping with The Mary Spender Store - but when all's said and done if stuff is bothering you then please email us at store@maryspender.com

General
These Terms and Conditions will apply to all transactions placed online, over the telephone or by mail order with The Mary Spender Store. Please read them carefully before placing any order. All contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights. By using this site you are agreeing to these Terms and Conditions.

Orders
We are pleased to accept orders by online transaction via secure server. All credit / debit card transactions are subject to validation checks and are authorised by the card issuer. We accept MasterCard, Visa, Delta, Switch, Maestro, Solo and American Express. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and / or non-delivery of your order. No orders will be accepted or processed without a valid card payment in the name of the registered cardholder.

Delivery
We aim to dispatch goods within 48 hours wherever possible, (with Weekends and UK Bank Holidays off). If for any reason there is a problem, we will notify you so that you can change or cancel your order if necessary.

Before you finalise and submit your order please ensure the delivery address is correct including the postcode.

All deliveries to destinations outside the UK may be subject to import duties and taxes, which are levied by the importing country at the time the delivery arrives in your country. All applicable duties, fees and any additional charges are outside of our control and please be aware YOU will be responsible for these payments.

If you need to return an item, please note that customs duties are not always refundable or fully refundable. This varies depending on your country’s individual regulations. For more information on your country’s import policy, please check with your local Customs office.

Missing Delivery - If you contact us to say that you have not received your order, we may ask you to check around your house/garden and with your neighbour as your parcel may have been left in a safe place or with a neighbour.

Faulty/Damaged Items - Please ensure that you check all items on receipt, as faulty or damaged items must be reported within 7 working days of receiving the parcel.

Domestic Shipping
The Mary Spender Store uses Royal Mail for either Standard Delivery or 'Tracked' Delivery depending on the service you choose at checkout.

Standard Delivery has NO tracking.
'Tracked' shipping provides a tracking number and we recommend this option. If your package is lost when using the 'Tracked' option The Mary Spender Store will provide a replacement free of charge.
Standard UK delivery - allow up to 5 working days.

International Shipping
The Mary Spender Store uses Royal Mail 'Standard' delivery for international packages or International 'Tracked', depending on the service you choose at checkout.

Standard Delivery has NO tracking.
'Tracked' shipping includes 'tracking' for your parcel and we recommend this option.
Please allow a minimum of 14 days for delivery to all non-UK destinations but please be aware that we have had instances of some packages taking up to 4 weeks to arrive due to Customs delays at the receiving country's end.

We highly recommend selecting the 'Tracked' shipping option for non-UK destinations.

Please remember that you are liable for any duties and taxes payable in your country.

Amendments and Cancellations
Amending Your Order
We're sorry that in some circumstances it's not possible to make changes to your order once you've placed it. However, if we can help we always will so email us at store@maryspender.com and we’ll do our best. If your order has not been dispatched we will issue a full refund.

Cancelling/Amending Your Order
If you've changed your mind about your order then you have a legal right to change your mind within 14 days after the day you received the order. You may amend or cancel your order by emailing us at store@maryspender.com and letting us know within the 14 days period.

If you have received your order then you must return it to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation of your order to us.

You will have to bear the direct cost of returning the products to us. Items lost in transit will not be treated as returned so we strongly recommend that you return items using some form of ‘Tracked’ service.

Once we receive your returned order, we’ll refund the person who originally placed and paid for the order. Please note we are not able to refund any postage charges. It's important that any unwanted item, unless faulty, is returned in its original condition and we expect this to mean that you've kept all original packaging and labels, and that it's undamaged and unused. Please include your invoice/delivery note with the returned items.

Products, Prices & Content
Whilst every effort is made to ensure the pictures and colours depicted on the site match as closely as possible those of the actual product due to technical limitations, some colours may vary.

All prices are shown in pound sterling (£).

Prices, product descriptions and specifications are checked to the best of our ability, and whilst huge effort has been made to make them accurate, no responsibility will be accepted for errors and omissions, (if you spot a howler, please do let us know so we can put it right).

We reserve the right to alter our prices and specifications without notice.

Payment
The Mary Spender Store does not have access to, or keep your credit or debit card details. Our store is hosted on Shopify Inc. who host and manage The Mary Spender Store. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

For our customers based in Europe, we have to inform you that a ruling by the European Court of Justice (ECJ) decided that the agreement (Safe Harbour Framework) which used to automatically allowed the transfer of data between the EU and the U.S. is no longer valid. So, while the paper-pushers re-negotiate we are legally obliged to make you aware that, if based in the EU, you have to consent to your information being transferred to the United States because that’s where The Mary Spender Store's shop solution (Shopify) is hosted. By continuing with your purchase(s) you will be deemed to have given your consent. Hopefully the bureaucrats will sort it out and common sense will prevail soon!

Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Your browser will confirm that you are shopping in a secure environment by showing a locked padlock icon or an image of a key in your browser.

Privacy
The Mary Spender Store collects and stores the information we need to process your order and contact you regarding that order. This will include name, address, delivery address, telephone number and email address. This information is shared with delivery and payment partners so we can get your order to you but no one else. The Mary Spender Store does NOT share its customer details with any other companies that may wish to flog you stuff.

If you choose to subscribe to Mary Spender's mailing list during the checkout process then we will send newsletters and updates from time to time. If this is too much then hit the unsubscribe link at any time.

Third Party Services - In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

In addition to the Information that you supply to The Mary Spender Store, information and data may be automatically collected through the use of cookies. Cookies are small files stored within your web browser from our website. Our website cookies do NOT collect personal information about you nor do they allow us to access your computer in any way. All information is collected lawfully and in accordance with the Data Protection Act 1998.

The Mary Spender Store uses tracking Cookies to identify which pages are being used. Simply put, this helps us analyse data about web page traffic and improve the website. This information is only used for statistical analysis purposes and no personally identifiable information is stored. All web browsers automatically accept Cookies, but you can modify your browser security settings to block them - although you should be warned that changing Cookie settings can adversely affect the performance of the website.

Cookies are text files containing small amounts of information which are downloaded to your device when you visit a website.
